It's more likely that you and your attorney will strike some kind of deferred adjudication agreement. Where you will pay a fine (perhaps $2000), do some community service (perhaps 80 hours), and you'll need to stay clean for a couple years and the charge will come off your record. They probably will ask you to go to some drug treatment, too. Depends on the laws in your state. 2. Get yourself a good lawyer QUICK, or a good Public Defender and cry addiction; i.e., you couldn't help yourself. 3. Did a doctor get you started on any of these drugs and then shut you off? If so, you have a case against the doctor. 4. How many scripts are they busting you for; i.e., how many did they find? 5. The State is going to consider this a CRIME AGAINST YOURSELF; i.e., you didn't hurt anyone else except yourself, so, with a good lawyer, your penalty shouldn't be that bad. 6. Prior Convictions: if none, get Accelerated Rehabilitation (AR); if this is a second or third bust, you still can beat this providing you can prove you have some mental deficiency and was UNABLE TO CONTROL YOURSELF. 7. Consider going to a mental health clinic for help with your addiction or with any mental aberration. If the Court knows that you tried to help yourself during this interim, they will look at your case differently. Make sure your lawyer knows everything you do to try to help yourself before the court date. Even if they are against you doing this, do it anywise. Demonstrate to the Court that you want to be a FUNCTIONING member of society, free from this drug affinity. If, however, you procured these drugs illegally and then got caught selling them, you can kiss your ass good-bye. That makes you a "seller," a "dealer," what-have-you, and the laws are strict. But if you used these drugs for yourself exclusively, then you're obviously an addict and couldn't help yourself, and you need help. This is such an "iffy" legal problem. Personally, I don't think you'll get jail time. These are just some of my ideas ... make sure you get a lawyer to discuss the legal aspects pertainable to your state. There is no such animal as a GOOD Public Defender!! Actually, there is no such thing as a GOOD lawyer, only competent lawyers. If you have to resort to a P.D., you better get your ass into rehab NOW, so you can cut a deal before you EVER set foot in a courtroom. Of course, had you ever been in trouble with the law before, you'd already know you ain't going to trial anyway. They will offer you a pretty good deal, as long as you are willing to go to rehab. Actually, if you've been doing this for two years, you probably NEED to go to a good rehab. I just hope to hell you have good insurance? Nothing worse than a bad rehab. By the way, if valium was your drug of choice, you'll love rehab!! They ply you with the things. I had to refuse them, I never did like the damn things. Good Luck, man. I doubt seriously you ever see a prison cell. However, a bad rehab is just as bad. Definately, get into "treatment" now. Having a piece of paper to prove to the DA that your already trying to straighten out your life is a very good thing. But shop around, find a rehab that isn't gonna fuck with ya too bad. And whatever ya do, lie your ass off at the rehab assessment interview and your pre-sentencing investigation. When dealing with a rehab, honesty is NOT the best policy. Downplay your use as much as will be believable. You may be correct BUT if someone goes to a pharmacy w/a forged prescription, the charge is "obtaining controlled substance by fraud and/or deceit". In Tenn. they really really don't go for this one!!!!!! They like to fine you about $3,000; sentence you to 11 mo., 29 days; 40 - 200 hours community service; EXTENDED probationary period. I live in WA state here we had 3 options based on the fact that I had no points accumulated (previous busts in WA) 1st offense option #1) jail time 0 to 90 days and fine #2)Pay into police drug fund DA sets price based on points accumulated. They wanted 2500.00 from me. #3)Treatment center, no less than 21 day in patient. Those were my options at the time I had very little money so option #2 was out. My attorney spoke with the DA the deal we agreed to was either 20 days jail or treatment. When sentencing came along I told my Attorney no treatment I'll take jail. The Judge didn't accept the DA's recommendation of 20 days, he gave me 10 days in jail no fine!! I served 8 days, because credit for good time. He he LOL!!!! I lucked out.
